Online Collection Service Agreement
This text is issued for Demo Tahsilat A.Ş.. The version published on the Portal as of 2026-11-01 applies and must be read before payment is confirmed.
1. Parties
This Online Collection Service Agreement (the Agreement) is made between the service provider identified below (the Provider) and the natural or legal person paying through the Portal (the Payer). It is governed by the Turkish Code of Obligations No. 6098, and, where the transaction is a consumer transaction, by Consumer Protection Law No. 6502 and the Distance Contracts Regulation, together with bank rules and payment-service rules under Law No. 6493 for card collection. Provider trade name: Demo Tahsilat A.Ş.. Workplace address: —. Tax office: —. Tax identification number: —. Phone: 0212 000 00 00. Email: destek@demo.mytahsilat.test. Complaints and notices: destek@demo.mytahsilat.test · 0212 000 00 00. The Payer is the person, or the authorised user, identified by the name, title, contact details and any billing details entered on the payment form. Those details are recorded at the time of payment.
2. Definitions
Portal: the online collection site operated for the Provider. Debt: a ledger balance, invoice, due, service fee, or a free amount the Payer chooses to pay. Collection: completion of the amount in favour of the Provider upon bank or virtual POS approval. Durable medium: email, SMS, the confirmation screen and the transaction record, where information is stored without alteration. Consumer: a natural or legal person acting outside a trade or profession. Pre-contract information: the nature of the service, the price, withdrawal exceptions and identity details shown before the payment obligation arises.
3. Subject
The subject is the secure payment, through the Portal, of a debt, due, service fee or free amount owed to the Provider, and the conditions of that collection service. The Portal is not a goods storefront. If a contract for goods or services already exists, this text only channels performance of that debt. Defects, delivery and rights under the underlying contract remain governed by that contract.
4. Nature and performance of the service
The service consists of entering a debt or free amount, a payment description, single payment or the instalment options shown on screen, card payment including 3D Secure, a collection record and, if configured, an email or SMS notice. Performance is complete when the Payer confirms Pay now and the bank approves the transaction. The confirmation screen and transaction number are evidence of performance. An unapproved transaction does not close a debt. The service is a collection service performed at the time of payment. No shipping restriction applies. The accepted instrument is the bank or credit card and virtual POS offered on the payment screen.
5. Price, tax and extra charges
The amount collected is the debt selected or the free amount entered by the Payer. Any commission, maturity difference or instalment difference is shown, before the payment obligation arises, as a rate and a total in the instalment table. The Payer is bound by the total that was confirmed. An extra charge that was not shown on screen is not payable; if such a charge was not disclosed, the Payer does not have to bear it. For a free payment, the price is the entered amount plus the selected instalment total. There is no distance-communication surcharge above the ordinary tariff. No deposit or security is required. This Portal does not create an open-ended subscription or periodic billing; each transaction is limited to its own amount.
6. Payment, instalments and exchange rates
The number of instalments and the commission are visible at the time of selection. Exchange rates are informational. A TCMB rate or a rate published on the Portal does not by itself determine the final bank charge. The final charge follows the card currency and the rules of the bank and card scheme. The bank may require extra authentication. The transaction is not approved until authentication is completed. The Payer acknowledges that the pay button creates a payment obligation.
7. Payer representations and duties
The Payer represents authority over the card and account, that the payment description is accurate, and that the card of another person is not used without authority. If the amount, debt or description is wrong or incomplete, the details entered by the Payer prevail. If unauthorised use is suspected, the Provider may refuse the transaction, refund the amount and notify the competent authorities. The Payer may not use automated queries or otherwise impair the system.
8. Provider duties
The Provider allocates an approved payment to the related debt or posts it to the ledger according to the description, keeps the transaction record and sends a notice if notifications are configured. The full card number, CVV and password are not stored on the Provider’s systems. Card data is sent to a PCI DSS compliant virtual POS channel. The page is served over HTTPS. Complaints are accepted via destek@demo.mytahsilat.test · 0212 000 00 00 and answered within a reasonable time.
9. Evidence
Electronic records, logs, the confirmation screen and the receipt are evidence under Article 193 of the Code of Civil Procedure No. 6100. The Payer accepts that these records, together with the Provider’s commercial books and system records, may be used as evidence. If a charge was taken on a failed or incomplete attempt, the amount is corrected under the refund terms.
10. Withdrawal, cancellation and refund
Cancellation, refund and withdrawal are governed by the Cancellation, Refund and Withdrawal Terms published on the Portal. Payment of a due debt in the correct amount is performance and is not undone by an unconditional fourteen-day withdrawal. For a consumer service that has not yet been performed, a withdrawal right remains for fourteen days from the contract date, without giving a reason. If the service was fully performed with the Payer’s express consent before that period ended, the right cannot be used. Withdrawal and refund notices are sent to destek@demo.mytahsilat.test · 0212 000 00 00.
11. Force majeure
Natural disaster, war, a widespread cyber attack, an outage of a bank or card scheme, and failure of power or internet infrastructure beyond the parties’ control are force majeure. Performance is suspended for the length of the outage. The Provider is not liable for that delay where it is not at fault. A transaction that could not be approved during the outage does not close the debt.
12. Limitation of liability
The Provider is liable, to the extent of its fault, for loss caused by a bank decline, a POS outage or third-party infrastructure. An unapproved transaction does not close a debt. Indirect loss of profit is limited to the amount of the relevant transaction, without prejudice to mandatory consumer rules. This limit does not apply in case of intent or gross negligence.
13. Personal data
Personal data is processed under the disclosure notice published on the Portal. Disclosure and consent are different acts. Making a payment shows that the notice was read. A separate consent box is not required for collection activity that does not legally depend on consent.
14. Intellectual property
The Portal software, marks and interface belong to the Provider or the infrastructure provider. The Payer may not copy them, reverse engineer them or reproduce them without permission.
15. Changes
The Provider may update this text. The version published on the Portal applies to transactions after publication. A transaction already started remains governed by the text in force when it started. Effective date: 2026-11-01.
16. Notices
Notices to the Provider are sent via destek@demo.mytahsilat.test · 0212 000 00 00. The Payer accepts the email and phone entered on the payment form as current contact details for service. Email is deemed received when the send record exists. Until a change of address or contact is notified, service on the previous details remains valid.
17. Disputes
In consumer matters, applications within the monetary limits are made to the consumer arbitration committee. Where Law No. 6502 Article 73/A makes mediation a condition of litigation, the consumer court is available only after that application. Disputes with a Payer acting for a commercial or professional purpose are governed by the laws of the Republic of Türkiye. The competent courts and enforcement offices are those of the Provider’s domicile.
18. Effectiveness and severability
Sending the payment form and confirming Pay now shows that the Payer has read and accepted the pre-contract information and this Agreement. For that transaction, the Agreement takes effect together with bank approval. If one clause is held invalid, the others remain in force. Matters not covered are governed by the Turkish Code of Obligations and mandatory consumer legislation.
